Texas Drug Crime Penalties
Each state classifies CDS differently in order to determine penalties for a conviction of any type. Texas classifies them depending on two factors: probably of abuse or addiction, and any known medical benefits.
Texas divides all controlled dangerous substances into one of six penalty groups:
- Penalty Group 1: Includes cocaine, heroin, methamphetamine, and Oxycodone
- Penalty Group 1-A: Includes LSD
- Penalty Group 2: Includes ecstasy, PCP, Mescaline, Marinol
- Penalty Group 2-A: Includes synthetic cannabinoids, such as “spice.”
- Penalty Group 3: Includes Valium, Xanex, Ritalin, and Hydrocodone less than 300mg
- Penalty Group 4: Includes morphine and certain opioids
Penalties for possession of these controlled substance can vary between a misdemeanor and a felony, depending on the amount sold. Marijuana is punished differently than these controlled substances due to its far more common nature.
